Die Kommission möchte auf das Urteil „CIA Security“ verweisen, das am 30. April 1996 in der Rechtssache C-194/94 (Slg. I, S. 2201) erging. Nach Auffassung des Gerichtshofs sind Artikel 8 und 9 der Richtlinie 98/34/EG (ehemalige 83/189/EWG) so auszulegen, daß Dritte sich vor nationalen Gerichten auf diese Artikel berufen können; es obliegt dann den nationalen Gerichten sich zu weigern, die Anwendung einer einzelstaatlichen technischen Vorschrift zu erzwingen, die nicht gemäß der Richtlinie notifiziert wurde.
