25. At the early stages of the proceedings, suspects or accused persons are particularly vulnerable and access to a lawyer is of paramount importance to protect the fair trial rights, inter alia the right to not incriminate oneself.[9] Article 6 of the ECHR requires that, as a rule,
a suspect should be granted access to legal assistance from the
moment he is taken into police custody or pre-trial deten
tion, and that such assistance should be ...[+++] assigned officially if need be.[10]
25. Verdächtige oder Beschuldigte bedürfen im Frühstadium des Verfahrens eines besonderen Schutzes. Rechtlicher Beistand ist in dieser Phase zur Wahrung des Rechts auf ein faires Verfahren, wozu auch das Recht gehört, sich nicht selbst zu belasten, unverzichtbar.[9] Nach Artikel 6 EMRK sollte ein Verdächtiger grundsätzlich ab dem Zeitpunkt, zu dem er in Polizeigewahrsam oder in Untersuchungshaft genommen wird, den Beistand eines Verteidigers erhalten, der erforderlichenfalls von Amts wegen zu bestellen ist.[10]
