Der Rahmenbeschluss über gemeinsame Ermittlungsgruppen gibt nicht den gesamten Wortlaut des Übereinkommens von 2000 wieder, was in der Übergangszeit bis zum Inkrafttreten des Übereinkommens von 2000 zu mangelnder Klarheit in Bezug auf Aspekte führen könnte wie die für die Bildung der Gruppen zuständige Behörde oder die Tatsache, dass bestimmte Ermittlungsmaßnahmen (beispielsweise verdeckte Ermittlungen oder kontrollierte Lieferungen, die die Gruppe nutzbringend durchführen könnten) im Rahmenbeschluss nicht geregelt sind.
