Although, under Community law, social services do not constitute a legally distinct category of service within services of general interest, the list above demonstrates their special role as pillars of the European society and economy, primarily as a result of their contribution to several essential values and objectives of the Community, such as achieving a high level of employment and social protection, a high level of human health protection, equality between men and women, and economic, social and territorial cohesion.
Auch wenn Sozialdienstleistungen nach einschlägigem Gemeinschaftsrecht keine klare rechtliche Kategorie innerhalb der Dienstleistungen von allgemeinem Interesse bilden, zeigt schon diese Aufzählung, dass ihnen trotzdem eine besondere Funktion als Säule der europäischen Gesellschaft und Wirtschaft zukommt. Diese ergibt sich zunächst aus ihrem Beitrag zu verschiedenen Zielen und wesentlichen Werten der Gemeinschaft – wie hohes Beschäftigungs- und Sozialschutzniveau, hohes Gesundheitsschutzniveau, Gleichstellung von Männern und Frauen, sozialer und regionaler Zusammenhalt.
