Die von Procter Gamble vorgeschlagene Prüfung, nämlich zunächst zu untersuchen, welches die gewöhnliche Aufmachung der betreffenden Ware auf dem Markt sei, und sodann, ob die Gestaltung der angemeldeten Ware für den Verbraucher merklich davon abweiche, bedeute, dass eine dreidimensionale Marke allein dann schon eingetragen werde müsste, wenn ihre Form sich von jeder anderen Form unterschiede, was im Widerspruch zu Artikel 7 Absatz 1 Buchstabe b der Verordnung Nr. 40/94 stünde.
