Consequently, on the basis of the information submitted by the Spanish authorities, the other national authorities, the European Committee for Standardisation (CEN) and the Standing Committee established by Directive 98/34/EC, it is clear that compliance with harmonised standard EN 71-1:1998 ‘Safety of Toys — Part 1: mechanical and physical properties’ can no longer be presumed to entail conformity with the essential safety requirements, in so far as concerns Clause 4.6 of that standard, and Clause 8.14 thereof, to the extent that it relates to the 24-hour submergence test.
Aus den von den spanischen Behörden, den anderen nationalen Behörden, dem Europäischen Komitee für Normung (CEN) und dem gemäß Richtlinie 98/34/EG eingesetzten Ständigen Ausschuss vorgelegten Informationen geht eindeutig hervor, dass nicht mehr davon ausgegangen werden kann, dass durch die Einhaltung der harmonisierten Norm EN 71-1:1998 „Sicherheit von Spielzeug — Teil 1: Mechanische und physikalische Eigenschaften“ die grundlegenden Sicherheitsanforderungen erfüllt werden; betroffen sind Klausel 4.6 dieser Norm und Klausel 8.14 hinsichtlich des 24 stündigen Eintauchens in Flüssigkeit.
