Without prejudice to the aim of this Regulation and its directly applicable provisions, a person who enters into transactions or issues orders to trade which may be deemed to constitute market manipulation may be able to establish that his reasons for entering into such transactions or issuing orders to trade were legitimate and that the transactions and orders to trade were in conformity with accepted practice on the market concerned.
Unbeschadet des Zwecks dieser Verordnung und ihrer unmittelbar anwendbaren Bestimmungen könnte eine Person, die Geschäfte abschließt oder Kauf- bzw. Verkaufsaufträge ausführt, die so betrachtet werden können, dass sie den Tatbestand einer Marktmanipulation erfüllen, geltend machen, dass sie legitime Gründe hatte, diese Geschäfte abzuschließen oder Aufträge auszuführen, und dass diese nicht gegen die zulässige Praxis auf dem betreffenden Markt verstoßen.
