However, Article 30 provides that Articles 28 and 29 of the EC Treaty shall not preclude prohibitions or restrictions on imports, exports or goods in transit justified "on grounds of . the protection of national treasures possessing artistic, historic or archaeological value". Therefore, pursuant to this Article, the Member States retain the right to define cultural goods which they consider to be national treasures and to take measures to protect them.
Gemäß Artikel 30 stehen jedoch die Bestimmungen der Artikel 28 und 29 Einfuhr-, Ausfuhr- und Durchfuhrverboten oder –beschränkungen nicht entgegen, sofern diese „zum Schutze [.] des nationalen Kulturgutes von künstlerischem, geschichtlichem oder archäologischem Wert [.] gerechtfertigt sind.“ Gemäß Artikel 30 sind die Mitgliedstaaten damit weiterhin berechtigt, Kulturgüter zu benennen, die sie als nationales Kulturgut betrachten, und die erforderlichen Maßnahmen zu ihrem Schutz zu treffen.
