Moving to proportionate liability may, therefore, work to the disadvantage of the plaintiff in two ways: First, it will mean he will not get 100 per cent or some settlement out of court for a large number; and, second, if there is only one group with deep pockets and they are only responsible for a small portion of the liability, their motivation to settle out of court would become much less than it is today.
