However, that cannot justify the non-application of the rule laid down in the first paragraph of Article 8 of the Conditions of Employment of Other Servants, which provides that ‘any further renewal’ following a first renewal for a fixed period of a temporary staff contract governed by Article 2(a) of the Conditions of Employment ‘shall be for an indefinite period’, that reclassification taking effect by operation of law.
Toutefois, cette circonstance ne saurait justifier la non-application de la règle énoncée à l’article 8, premier alinéa, du régime applicable aux autres agents, selon laquelle « tout renouvellement ultérieur » à une première prolongation pour une durée déterminée d’un contrat d’agent temporaire, au titre de l’article 2, sous a), dudit régime, « devient à durée indéterminée », cette requalification opérant de plein droit.
