Although the contracting authority is not obliged to give reasons for a promotion decision, either to its addressee or to the candidates who were not promoted, it is, on the other hand, obliged to state the grounds for its decision rejecting a complaint lodged pursuant to Article 90(2) of the Staff Regulations by a candidate who was not promoted, the grounds for that decision being deemed to be identical to those for the decision against which the complaint was made.
Si l’autorité habilitée à conclure les contrats n’est tenue de motiver une décision de promotion ni à l’égard de son destinataire ni à l’égard des candidats non promus, elle a, en revanche, l’obligation de motiver sa décision portant rejet d’une réclamation introduite en vertu de l’article 90, paragraphe 2, du statut par un candidat non promu, la motivation de cette décision de rejet étant censée coïncider avec la motivation de la décision contre laquelle la réclamation était dirigée.
