Das griechische Gericht führt aus, dass im Ausgangsrechtsstreit zu bestimmen sei, ob das ESZ, über das Daiichi Sankyo von 2006 bis 2011 verfügt habe, also in dem Zeitraum, in dem sich DEMO angeschickt habe, Arzneimittel in den Verkehr zu bringen, die das pharmazeutische Erzeugnis enthielten, die Erfindung dieses pharmazeutischen Erzeugnisses oder nur die Erfindung des Verfahrens zu seiner Herstellung geschützt habe.
The Greek court explains that the main proceedings have to determine whether the SPC held by Daiichi Sankyo from 2006 to 2011 – in other words, in the period during which DEMO was preparing to market the medicinal product containing the pharmaceutical product – covered the invention of the pharmaceutical product or only the invention of its process of manufacture.
