In diesem Zusammenhang sollte der Rechtsprechung des Europäischen Gerichtshofs für Menschenrechte Rechnung getragen werden, der zufolge die Zulassung von Aussagen, die unter Verstoß gegen Artikel 3 EMRK durch Folter oder sonstige Misshandlung erlangt wurden, als Beweismittel zur Feststellung des Sachverhalts in einem Strafprozess dazu führt, dass das Verfahren insgesamt als unfair zu betrachten ist.
In that context, regard should be had to the case-law of the European Court of Human Rights, according to which the admission of statements obtained as a result of torture or of other ill-treatment in breach of Article 3 ECHR as evidence to establish the relevant facts in criminal proceedings would render the proceedings as a whole unfair.
