4. Verfügt eine Person, die in dem Zeugnis als zur Verfügung über Nachlassvermögen berechtigt bezeichnet wird, über Nachlassvermögen zugunsten eines anderen, so gilt dieser andere, falls er auf der Grundlage der in dem Zeugnis enthaltenen Angaben handelt, als Person, die von einem zur Verfügung über das betreffende Vermögen Berechtigten erworben hat, es sei denn, er wusste, dass das Zeugnis inhaltlich unrichtig ist, oder es war ihm dies infolge grober Fahrlässigkeit nicht bekannt.
4. Where a person mentioned in the Certificate as authorised to dispose of succession property disposes of such property in favour of another person, that other person shall, if acting on the basis of the information certified in the Certificate, be considered to have transacted with a person with the authority to dispose of the property concerned, unless he knows that the contents of the Certificate are not accurate or is unaware of such inaccuracy due to gross negligence.
