The Commission is of the opinion that limiting the right to deduct VAT after the event, despite the evidence that the costs involved were incurred for strictly business purposes and as part of taxed operations, seems to run counter to the right to deduct VAT, which guarantees the neutral nature of this tax, as established by the Court of Justice in its rulings of 19 September 2000 in the Ampafrance (C-177/99) and Sanofi (C-181/99) cases.
Die Kommission vertritt die Auffassung, dass eine nachträgliche Einschränkung des Rechts auf Absetzbarkeit von der Mehrwertsteuer trotz des Nachweises, dass die betreffenden Aufwendungen eindeutig beruflichen Zwecken dienten, und im Rahmen besteuerbarer Tätigkeiten anfielen im Widerspruch zum Recht auf Abzug von der Mehrwertsteuer steht, das die Neutralität dieser Steuer gewährleistet, wie der Gerichtshof in seinem Urteil vom 19.9.2000 in den Rechtssachen Ampafrance (C-177/99) und Sanofi (C-181/99) entschied.
