As the Advocate General stated, in paragraph 172 of her Opinion, national law is applicable in the context of investigations conducted by the Commission as European competition authority only in so far as the authorities of the Member States lend their assistance, in particular with a view to overcoming opposition by the undertakings concerned through the use of coercive measures, in accordance with Article 14(6) of Regulation No 17 or Article 20(6) of Regulation No 1/2003.
Wie die Generalanwältin in Nr. 172 ihrer Schlussanträge ausgeführt hat, kommt bei Nachprüfungen der Kommission als europäischer Kartellbehörde nationales Recht nur insoweit zum Einsatz, als die Behörden der Mitgliedstaaten ihr Amtshilfe leisten, insbesondere wenn es darum geht, Widerstand der betroffenen Unternehmen gemäß Art. 14 Abs. 6 der Verordnung Nr. 17 bzw. Art. 20 Abs. 6 der Verordnung Nr. 1/2003 durch Anwendung unmittelbaren Zwangs zu überwinden.
