Therefore, even though Article 12(5) TRLIS does not explicitly exclude to take into account the book value reflected on the consolidated statements, the book value that it refers to should be the one contained in the individual accounts of the acquired non-resident company, otherwise the provision would have explicitly made a reference to the accounting rules like it is the case in other fiscal provisions of the Spanish corporate tax law.
Aus diesem Grund müsse der Buchwert, auf den Artikel 12 Absatz 5 TRLIS verweist, der im Einzelabschluss des erworbenen nicht in Spanien ansässigen Unternehmens ausgewiesene Buchwert sein, auch wenn Artikel 12 Absatz 5 TRLIS eine Berücksichtigung des im konsolidierten Abschluss ausgewiesenen Buchwerts nicht ausdrücklich ausschließe. Andernfalls würde die Bestimmung ausdrücklich auf die Rechnungslegungsvorschriften verweisen, was in anderen Steuerbestimmungen des spanischen Körperschaftsteuergesetzes der Fall sei.
