(82) The Commission considers that the attribution of the total residual value of the formation of the western mine waste tip and the access tracks as a loss due to the reduction of activity is excessive, since the possibility of abandoning the western side had been foreseen in the July 1994 plan and, to quote form the 1994 plan, "raising the bottom of the cutoff automatically makes available more than sufficient capacity for internal dumping, since the total volume of dead rock is decreased and it can be disposed of in a large cavity at the north end present in the base at a height of approximately 530 a.s.l".
(82) Nach Einschätzung der Kommission ist es übertrieben, den gesamten Restwert für die Anlage der Westhalde und der Zugangswege als Verluste infolge der Rücknahme der Fördertätigkeit zu verbuchen, zumal die Möglichkeit einer Aufgabe der Westflanke bereits im Plan vom Juli 1994 vorgesehen war und es in dem Plan von 1994 heißt: "das Ansteigen der Sohle schafft automatisch mehr als ausreichende Kapazitäten für die interne Ablagerung des Abraums und bewirkt, dass weniger Abraum bewegt und in einer großen Grube im äußersten Norden abgelagert werden muss, deren Sohle bei etwa 530 m liegt".
