Within two months from the day of receipt, the Agency shall provide a duly reasoned opinion as well as recommendations to the ENTSO for Gas and to the Commission where it considers that the draft annual work programme or the draft Community-wide network development plan submitted by the ENTSO for Gas do not contribute to non-discrimination, effective competition, the efficient functioning of the market or a sufficient level of cross-border interconnection open to third-party access.
Innerhalb von zwei Monaten ab dem Tag des Eingangs der Unterlagen gibt die Agentur eine ordnungsgemäß begründete Stellungnahme ab und richtet Empfehlungen an den ENTSO (Gas) und an die Kommission, falls ihres Erachtens der Entwurf des Jahresarbeitsprogramms oder der Entwurf des gemeinschaftsweiten Netzentwicklungsplans, die vom ENTSO (Gas) vorgelegt wurden, nicht zur Nichtdiskriminierung, zum echten Wettbewerb, zum effizienten Funktionieren des Marktes oder zu einem ausreichenden Maß an grenzüberschreitenden Verbindungsleitungen, die Dritten offen stehen, beiträgt.
