In recognition of this, Article 9 of the Rome II Regulation on the law applicable to non-contractual obligations specifies that ‘the law applicable to a non-contractual obligation in respect of the liability of a person in the capacity of a worker or an employer or the organisations representing their professional interests for damages caused by an industrial action, pending or carried out, shall be the law of the country where the action is to be, or has been, taken’.
Dieser Tatsache trägt Artikel 9 der Rom-II-Verordnung über das auf außervertragliche Schuldverhältnisse anzuwendende Recht Rechnung, wonach „auf außervertragliche Schuldverhältnisse in Bezug auf die Haftung einer Person in ihrer Eigenschaft als Arbeitnehmer oder Arbeitgeber oder der Organisationen, die deren berufliche Interessen vertreten, für Schäden, die aus bevorstehenden oder durchgeführten Arbeitskampfmaßnahmen entstanden sind, das Recht des Staates anzuwenden [ist], in dem die Arbeitskampfmaßnahme erfolgen soll oder erfolgt ist.“
