As regards the regime applicable to Lloyd's prior to the entry into force of the Financial Services and Markets Act, the Commission has consistently maintained, in full accordance with ECJ case law, that the objective of infringement proceedings under European Union law is to establish or restore the compatibility of existing national law with European Union law and not to rule on the possible past incompatibility of national law, which has been in the meantime brought into compliance with European law.
Was das System betrifft, wie es für Lloyd’s vor dem In-Kraft-Treten des Financial Services and Markets Act galt, hat die Kommission, in vollem Einklang mit der Rechtsprechung des EGH, stets die Auffassung vertreten, dass das Ziel von Vertragsverletzungsverfahren gemäß den Rechtsvorschriften der Europäischen Union darin besteht, die Vereinbarkeit geltenden nationalen Rechts mit der Gesetzgebung der Europäischen Union herzustellen bzw. wieder herzustellen, und nicht, über die mögliche Unvereinbarkeit nationalen Rechts in der Vergangenheit, das inzwischen in Übereinstimmung mit dem europäischen Recht gebracht wurde, zu befinden.
