1. Where the customs authorities, in the course of action in one of the situations referred to in Article 1(1) and before an application has been lodged by a right-holder or granted, have sufficient grounds
for suspecting that goods infringe an intellectual property right, they may suspend the release of the goods or detain them for a period of three working days

(1) Ergibt sich, bevor ein Antrag des Rechtsinhabers gestellt oder zugelassen worden ist, bei einem Tätigwerden der Zollbehörden in einer der in Artikel 1 Absatz 1 genannten Situationen der hinreichend begründete Verdacht, dass Waren ein Recht geistigen Eigentums verletzen, so können die Zollbehörden für drei Arbeitstage nach Eingang der Benachrichtigung bei dem Rechtsinhaber sowie dem Anmelder oder dem Besitzer der Waren, sofern diese bekannt sind, die Überlassung der Waren aussetzen oder die Waren zurückhalten, um dem Rechtsinhaber die Möglichkeit zu geben, einen Antrag auf Tätigwerden nach Artikel 5 zu stellen.
