The assessment of the centre of gravity would change if the parties would have engaged in the joint production in any event, that is to say, irrespective of the joint RD, or if the agreement provided for a full integration in the area of production and only a partial integration of some RD activities. In this case, the centre of gravity of the co-operation would be the joint production.
Der Schwerpunkt wäre ein anderer, wenn sich die Parteien ohnehin, d. h. unabhängig von der gemeinsamen FuE, an einer gemeinsamen Produktion beteiligt hätten oder wenn die Vereinbarung zwar eine vollständige Integration im Bereich der Produktion, aber nur eine Teilintegration einiger FuE-Tätigkeiten vorsähe.
