In the same conclusions, the Council pointed out that Article 152 of the Treaty establishing the European Community states that a high level of human health protection shall be ensured by the Community, with the proviso that Community action in the field of public health fully respects the responsibilities of the Member States for the organisation and delivery of health services and medical care and can therefore only complement national policies.
In denselben Schlussfolgerungen betonte der Rat, dass Artikel 152 des Vertrags zur Gründung der Europäischen Gemeinschaft festlegt, dass ein hohes Maß an Schutz für die menschliche Gesundheit durch die Gemeinschaft gewährleistet werden muss, vorausgesetzt, die Tätigkeit der Gemeinschaft auf dem Gebiet des Gesundheitswesens respektiert voll und ganz die Verantwortung der Mitgliedstaaten für die Organisation und Erbringung von Gesundheitsleistungen und medizinischer Versorgung und kann deshalb die einzelstaatlichen Politikmaßnahmen nur ergänzen.
