The Court also ruled against Italy for failing to comply with Community law and allow lawyers who are nationals of other Member States to make use of the infrastructure in Italy required for carrying out their duties, and requiring them to continue to reside in the judicial district of the court to which the Bar at which enrolment is sought is attached so as not to have to transpose fully Directive 89/48 on a general system for the recognition of diplomas.
Italien wird ebenfalls vom Gerichtshof verurteilt, weil es unter Verstoß gegen das Gemeinschaftsrecht Rechtsanwälten aus anderen Mitgliedstaaten nicht gestattet, in diesem Staat über die zur Erbringung ihrer Dienstleistungen erforderliche Infrastruktur zu verfügen, und weil es sie verpflichtet, im Bezirk des Gerichts zu wohnen, in dessen Liste sie eingetragen sind, um die Richtlinie 89/48 über eine allgemeine Regelung zur Anerkennung der Hochschuldiplome nicht vollständig umsetzen zu müssen.
