The wording of Article 6 in the common position is a retrograde step with regard to the Commission proposal and the amendments put forward by the European Parliament at first reading: first, it makes economic operators responsible for requiring that the confidentiality of their tenders be respected; secondly, it makes the issue of the confidentiality of tenders subject to the national law of the contracting authority in question, which is contrary to the aims of the European internal market.
