Recalls that the new Treaties no longer make specific reference to the Council's obligation to define the cases in which it acts in a legislative capacity and to the need to preserve the effectiveness of its decision-making process (Article 207(3) of the former TEC) – the so-called ‘space to think’ – and that the current ‘survival’ of this concept is based only on Article 4(3) of Regulation (EC) 1049/2001 as far as legislative procedures are concerned;
25. weist darauf hin, dass mit den neuen Verträgen nicht mehr besonders auf die Pflicht des Rates, die Fälle festzulegen, in denen er als Gesetzgeber tätig wird, und auf die Notwendigkeit, die Wirksamkeit seines Beschlussfassungsverfahrens zu wahren (Artikel 207 Absatz 3 des früheren EGV), den so genannten „Schutz der Vertraulichkeit“ verwiesen wird, und dass das Weiterbestehen dieses Konzepts allein durch Artikel 4 Absatz 3 der Verordnung (EG) 1049/2001 begründet ist, soweit es die Rechtsetzungsverfahren betrifft;
