Any authority which finds, in the course of that assessment, that the person concerned has – like D – occupied a prominent position within an organisation which uses terrorist methods is entitled to presume that that person has individual responsibility for acts committed by that organisation during the relevant period. Nevertheless, it is still necessary to examine all the relevant circumstances before a decision excluding that person from refugee status can be adopted.
Eine staatliche Stelle, die bei dieser Prüfung feststellt, dass die betreffende Person, wie D, eine hervorgehobene Position in einer sich terroristischer Methoden bedienenden Organisation innehatte, kann vermuten, dass diese Person eine individuelle Verantwortung für von dieser Organisation im relevanten Zeitraum begangene Handlungen trägt, jedoch bleibt nichtsdestoweniger die Prüfung sämtlicher erheblicher Umstände erforderlich, bevor die Entscheidung erlassen werden kann, die betreffende Person von der Anerkennung als Flüchtling auszuschließen.
