The German authorities note that the Commission itself had taken the view, in its 1998 Notice on business taxation, that, ‘provided that they apply without distinction to all firms and to the production of all goods’, tax measures of a purely technical nature, such as rules on loss carry-overs, were not selective, and that ‘the fact that some firms or some sectors benefit more than others from some of these tax measures does not necessarily mean that they are caught by the competition rules governing State aid’ (17).
Deutschland weist darauf hin, dass die Kommission in ihrer Mitteilung zur Unternehmensbesteuerung 1998 selbst die Auffassung vertritt, dass rein steuertechnische Maßnahmen wie Vorschriften über den Verlustvortrag nicht selektiv sind, „vorausgesetzt sie gelten gleichermaßen für alle Unternehmen und Produktionszweige“, und dass „die Tatsache, dass bestimmte Unternehmen oder Produktionszweige mehr als andere in den Genuss derartiger steuerlicher Maßnahmen gelangen, [.] nicht zwangsläufig zur Folge [hat], dass diese in den Anwendungsbereich der für staatliche Beihilfen relevanten Wettbewerbsvorschriften fallen“ (17).
