34 As regards the mark applied for, the Court of First Instance observed, first of all, that average consumers are not in the habit of making assumptions about the origin of products on the basis of their shape or the shape of their packaging in the absence of any graphic or word element, and that consumers first see the bottles in which such goods are contained as a means of packaging.
Zur angemeldeten Marke hat das Gericht zunächst ausgeführt, dass die Durchschnittsverbraucher aus der Form der Waren oder der ihrer Verpackung, wenn grafische oder Wortelemente fehlten, gewöhnlich nicht auf die Herkunft dieser Waren schlössen und den Flaschen, die solche Waren enthielten, in erster Linie eine reine Verpackungsfunktion zuschrieben.
