This document is thus intended to supplement the content of the affidavit of the applicant’s Vice President of Events, Promotions, which was submitted to the examiner and which, as the Board of Appeal stated in paragraph 23 of the contested decision, reproducing the examiner’s findings, contains figures relating to sales volumes which are not broken down by country, do not indicate the overall amount for the European Union and are not confirmed by other documents, such as invoices.
Dieses Dokument soll somit den Inhalt der beeideten Erklärung des Direktors für Marketing und Events der Klägerin ergänzen, die dem Prüfer vorgelegt worden war und die, wie die Beschwerdekammer in Rn. 23 der angefochtenen Entscheidung unter Wiedergabe von Erwägungen des Prüfers ausgeführt hat, Zahlen zum Absatzvolumen enthält, die nicht nach Ländern aufgeschlüsselt sind, nicht den Gesamtbetrag für die Union erkennen lassen und nicht durch weitere Dokumente wie beispielsweise Rechnungen bestätigt werden.
