Die Verordnung (EWG) Nr. 2828/93 in der durch die Verordnung (EG) Nr. 2206/94 der Kommission (5) geänderten Fassung wird nicht auf Öle angewandt, deren physikalisch-chemische Merkmale eine Verwechslung mit Olivenöl ausschließen. Da bei diesen besonderen Ölen erfahrungsgemäß keine mißbräuchliche Verwendung droht, sollte die Sicherheit für die Mengen, die vor Inkrafttreten der Verordnung (EG) Nr. 2206/94 zum zollrechtlich freien Verkehr abgefertigt wurden, ohne Vorlage des Kontrollexemplares T5 freigegeben werden können.
