5. For the purposes of point (a) of paragraph 3, a group shall be deemed to be failing or to be likely to fail where the group infringes, or there are objective elements to support a determination that the group, in the near future, will infringe its consolidated prudential requirements in a way that would justify action by the ECB or the national competent authority, including but not limited to the fact that the group has incurred or is likely to incur losses that will deplete all or a significant amount of its own funds.
(5) Für die Zwecke des Absatzes 3 Buchstabe a gilt eine Gruppe als ausfallende oder wahrscheinlich ausfallende Gruppe, wenn sie gegen ihre konsolidierten Aufsichtsanforderungen in einer Weise verstößt, die ein Eingreifen der EZB oder der zuständigen Behörde rechtfertigen würde, oder wenn objektive Anhaltspunkte dafür vorliegen, dass dies in naher Zukunft der Fall sein wird, unter anderem weil die Gruppe Verluste erlitten hat oder voraussichtlich erleiden wird, durch die die Gesamtheit oder ein wesentlicher Teil ihrer Eigenmittel aufgebraucht wird.
