(48b) The mere fact that, in good faith market-makers, bodies authorised to act as counterparties, or persons authorised to execute orders on behalf of third parties with inside information confine themselves, in the first two cases, to pursuing their legitimate business of buying or selling financial instruments or, in the last case, to carrying out an order dutifully, should not be deemed alone to constitute use of such inside information.
(48b) Der Umstand, dass in gutem Glauben handelnde Market-Maker oder Stellen, die befugt sind, als Gegenpartei aufzutreten, oder Personen, die an der Börse Kundengeschäfte ausführen, zwar über Insider-Informationen verfügen, jedoch in den ersten zwei Fällen lediglich ihr legitimes Geschäft des Ankaufs oder Verkaufs von Finanzinstrumenten ausüben oder im letztgenannten Fall pflichtgemäß Aufträge ausführen, sollte als solcher nicht als Ausnutzung von Insider-Informationen gewertet werden.
