As is well known, there has existed, and to some extent still exists, a doctrinal dispute between those who believe that fundamental human rights include the rights to food supplies, work and development, and those who, preferring the legal and political restriction of the territory of human rights to the area of individual civil and political rights in the strict sense, believe that any steps to give juridical status to economic, social and cultural rights are liable to sow confusion.

Wie bekannt ist, gab es eine teils heute noch geführte grundsätzliche Diskussion zwischen denjenigen, die das Recht auf Nahrung, Arbeit und Entwicklung zu den Grundrechten des Menschen zählen, und denen, die das Gebiet der Menschenrechte juristisch und politisch auf das konkrete Feld der bürgerlichen und politischen Privilegien des Individuums bezogen wissen wollen und in jedem weiteren Schritt hin zur letztlichen Opferung der Juridizität der WSKR ein Element der Konfusion sehen.
