Beihilfemaßnahmen, welche die Kommission im Rahmen des Übergangsverfahrens gebilligt hat. Nach dem Tag des Beitritts weiterhin anzuwendende Maßnahmen, die staatliche Beihilfen darstellen und nicht die vorstehend aufgezählten drei Voraussetzungen erfüllen, sind zum Tag des Beitritts als neue Beihilfe anzusehen. Demnach hat die Kommission alle Befugnisse, die Anwendung solcher Maßnahmen zu untersagen, sofern diese nicht vereinbar mit dem Gemeinsamen Markt sind.
