Having lost before the lower courts, RWE turned to the Bundesgerichtshof (Federal Court of Justice, Germany), which puts questions to the Court of Justice on the interpretation of the rules of EU law intended to protect consumers against unfair and/or non-transparent standard contractual terms . The German court is uncertain in particular about the scope of the exclusion from review for unfairness of standard terms which merely reproduce mandatory statutory or regulatory provisions.
Nachdem RWE vor dem Landgericht und dem Oberlandesgericht unterlegen war, legte das Unternehmen Revision beim Bundesgerichtshof ein, der den Gerichtshof um Auslegung der Bestimmungen des Unionsrechts ersucht, mit denen die Verbraucher vor missbräuchlichen und/oder intransparenten Standardvertragsklauseln geschützt werden sollen. Für den Bundesgerichtshof stellt sich u. a. die Frage, in welchem Umfang Standardklauseln, die lediglich bindende Rechtsvorschriften aufgreifen, von einer Missbrauchskontrolle ausgeschlossen sind.
