In response to the question whether Ving had indicated the product’s main characteristics to an extent appropriate to the medium and the product the ECJ ruled that, while it was up to the national court to make an assessment in concreto, ‘a verbal or visual reference to the product makes it possible to meet the requirement relating to the indication of the product’s characteristics’ and that a reference to the trader’s website may be used under certain circumstances to provide certain information on the product’s main characteristics.
In Beantwortung der Frage, ob Ving die wesentlichen Merkmale des Produkts in dem für das Medium und das Produkt angemessenen Umgang angegeben habe, befand der EuGH, dass „eine Bezugnahme auf das Produkt in Wort oder Bild erlaubt, die Voraussetzung der Angabe der Merkmale des Produkts zu erfüllen“, wobei die Prüfung im Einzelfall Sache des Gerichts sei, und dass ein Verweis auf die Website des Gewerbetreibenden unter bestimmten Umständen zulässig ist, um bestimmte Informationen zu den maßgeblichen Merkmalen des Produkts bereitzustellen.
