Ist das zugunsten der beschuldigten Person entstandene subjektive Recht auf Einstellung des Strafverfahrens (unter den oben dargelegten Bedingungen) mit dem Unionsrecht vereinbar, obwohl die Möglichkeit besteht, den vom Staatsanwalt nicht behobenen „Verstoß gegen wesentliche Verfahrenserfordernisse“ vollumfänglich durch Maßnahmen des Gerichts im Gerichtsverfahren zu heilen, sodass letztendlich die rechtliche Situation der beschuldigten Person identisch mit der wäre, die sie bei rechtzeitiger Behebung dieses Verstoßes gehabt hätte?
Is the subjective right of the accused to have the criminal proceedings terminated (under the above conditions) compatible with EU law, notwithstanding the fact that the ‘infringement of essential procedural requirements’ which the prosecutor has failed to remedy may be fully remedied as a result of measures taken by the court in the judicial proceedings, so that ultimately the legal position of the accused is identical to that which he would have had if the infringement had been remedied in due time?
