Im Oktober 2003 nahm das österreichische Parlament ein neues Asylgesetz an, das von verschiedenen NRO, wie der humanitären Organisation „Caritas“, als das restriktivste Gesetz in Europa betrachtet wird, was besonders mit zwei weitreichenden neuen Bestimmungen dieses Gesetzes zusammenhängt: der Möglichkeit, Asylbewerber während des Berufungsverfahrens abzuschieben, und der Nichtzulässigkeit neuer Gründe und Fakten im Berufungsverfahren aufgrund der Tatsache, dass die Berufung keine aufschiebende Wirkung hat und der Schwierigkeit, nach Ablehnung eines Asylgesuchs neue Gründe geltend zu machen, was vom HCR streng kritisiert wurde.
In October 2003, the Austrian parliament passed a new law on asylum which is considered by several NGOs, including the humanitarian organisation 'Caritas', as the most restrictive in Europe, especially as a result of two major new provisions in the law: the possibility of expelling the asylum seeker during the appeal procedure and the ban on submitting new evidence during the appeal procedure, owing to the fact that the appeal does not have suspensive effect and the difficulty of accepting new evidence after rejection of an application.
