It is also clear from case-law that the administration must examine complaints with an open mind and it is sufficient, in order for it to consider that it is dealing with a complaint within the meaning of Article 90(2) of the Staff Regulations, that a plea has already been raised in the administrative procedure sufficiently clearly to enable the appointing authority to know the criticisms made by the person concerned of the contested decision (see judgment of 13 January 1998 in Case T-176/96 Volger v Parliament, paragraph 65).
Aus der Rechtsprechung geht auch hervor, dass sich die Verwaltung mit den Beschwerden offen auseinandersetzen muss und dass eine Beschwerde im Sinne von Art. 90 Abs. 2 des Statuts bereits dann anzunehmen ist, wenn zuvor im Verwaltungsverfahren eine Rüge hinreichend klar vorgebracht wurde, so dass die Anstellungsbehörde in der Lage war, die Beanstandungen zur Kenntnis zu nehmen, die der Betroffene gegenüber der angefochtenen Entscheidung erhoben hat (vgl. Urteil des Gerichts erster Instanz vom 13. Januar 1998, Volger/Parlament, T-176/96, Randnr. 65).
