In Daihatsu Deutschland, cited above, the Court ruled that Article 6 of the First Directive was to be interpreted as precluding the legislation of a Member State from restricting to members or creditors of the company, the central works council or the company's works council the right to apply for imposition of the penalty provided for by the law of that Member State in the event of failure by a company to fulfil the obligations regarding disclosure of annual accounts laid down by the First Directive.
In dem Urteil Daihatsu Deutschland hat der Gerichtshof für Recht erkannt, daß Artikel 6 der Ersten Richtlinie dahin auszulegen ist, daß er den Rechtsvorschriften eines Mitgliedstaats entgegensteht, die nur den Gesellschaftern, den Gläubigern und dem Gesamtbetriebsrat bzw. dem Betriebsrat der Gesellschaft das Recht einräumen, die Verhängung der Maßregel zu beantragen, die das nationale Recht für den Fall vorsieht, daß eine Gesellschaft den durch die Erste Richtlinie aufgestellten Pflichten auf dem Gebiet der Offenlegung des Jahresabschlusses nicht nachkommt.
