Intended, in instances where the Treaty does not provide an explicit legal basis, to enable the Council to ‘take the appropriate decisions’ to ‘attain . one of the objectives of the Community’, Article 308 represents, in terms of the hierarchy of acts, a dual anomaly: a hybrid article, half constitutional and half legislative, it amalgamates in a single act the legal basis and the corresponding legislative provisions.
