Neben anderen Aspekten ist dies dann der Fall, wenn es die Komplementarität der staatlichen und privaten Rechtsdurchsetzung billigt und sich unter der Vermeidung der Exzesse von US-Sammelklagen für Sammelklagen ausspricht und somit die Geltendmachung von Schadenersatzansprüchen erleichtert, wenn es unter Vermeidung von Ausforschungsaufträgen den Zugang zu relevanten Informationen unter gerichtlicher Kontrolle vorschlägt und wenn es die Erhebung von eigenständigen Klagen sowie Folgeklagen und ein freiwilliges Entschädigungssystem anerkennt und fordert.
