Since Article 30 of the EC Treaty provides for an exception, to be interpreted strictly (20), to the rule of free movement of goods within the Community, it is for the national authorities which invoke it to show in each case that the application of their rules is necessary to give effective protection to the interests referred to in Article 30 of the EC Treaty and, in particular, that the approval of the motor vehicle in question poses a real risk to human health or road safety.
Da Artikel 30 EG-Vertrag, der Ausnahmen vom Grundsatz des freien Warenverkehrs zulässt, eng auszulegen ist (20), müssen nationale Stellen, die sich auf ihn berufen, in jedem Einzelfall darlegen, dass ihre Maßnahme zum wirksamen Schutz der von Artikel 30 EG-Vertrag erfassten Interessen erforderlich ist und insbesondere, dass die Genehmigung des infrage stehenden Kraftfahrzeugs eine tatsächliche Gefahr für die Gesundheit oder die Verkehrssicherheit darstellt.
