33 Insbesondere wenn, wie im vorliegenden Fall, die angemeldete Marke aus der dreidimensionalen Form der Verpackung der betroffenen Waren besteht – erst recht wenn die Vermarktung dieser Waren aufgrund von deren Natur eine Verpackung verlangt, so dass die gewählte Verpackung der Ware ihre Form verleiht und für die Prüfung der Anmeldung der Form der Ware gleichzusetzen ist (Urteil Henkel, Randnr. 33) –, können die Normen oder Gewohnheiten maßgeblich sein, die im Bereich der Verpackung von Waren gleicher Art gelten, die für dieselben Verbraucher bestimmt sind wie die Waren, für die die Eintragung beantragt wird.
