Although the amount of the book order seemed to exceed the amount resulting from those past measures, the Commission is of the view that a rational market operator would have also taken into consideration the probability that ENVC would have been able to carry out the constructions at a profit and/or within the contractual deadlines so as to avoid the payment of penalties (32).
Auch wenn der Wert des Auftragsbestands höher zu sein schien als der sich aus den bisherigen Maßnahmen ergebende Betrag, ist die Kommission der Ansicht, dass ein rational handelnder Marktteilnehmer auch die Wahrscheinlichkeit mitberücksichtigt hätte, ob ENVC in der Lage sein wird, die Bauleistungen gewinnbringend und/oder innerhalb der Vertragsfristen auszuführen, sodass es zu keinen Strafzahlungen kommt (32).
