In response to a reference for a preliminary ruling, the Court considered in its Judgment of 16 October 2003(115) that with regard to the payment collected in return for access to airport facilities, Directive 96/67/EC "does not prevent the fee from being determined in such a way that the managing body of the airport is able not only to cover the costs associated with the provision and maintenance of airport installations, but also to make a profit".
