2. For the purpose of the suggested actions referred to in paragraph 1, namely sighting and reporting, discreet surveillance, specific checks, or operational analysis, personal data within any of the categories referred to in Article 3 may be included in the Customs Information System only if, especially on the basis of prior illegal activities, there are real indications to suggest that the person concerned has committed, is in the act of committing, or will commit serious contraventions of national laws.
(2) Für die in Absatz 1 genannten vorgeschlagenen Maßnahmen, sei es eine Feststellung oder Unterrichtung, verdeckte Registrierung, gezielte Kontrolle oder operativen Analyse, dürfen personenbezogene Daten der Kategorien nach Artikel 3 nur dann in das Zollinformationssystem aufgenommen werden, wenn es – vor allem aufgrund früherer illegaler Handlungen – tatsächliche Anhaltspunkte dafür gibt, dass die betreffende Person eine schwere Zuwiderhandlung gegen einzelstaatliche Rechtsvorschriften begangen hat, begeht oder begehen wird.
