Consequently, the Advocate General considers that periods of on-call duty carried out by a doctor in a hospital constitute in their entirety working time, within the meaning of the Working Time Directive, even if the doctor is able to sleep during periods of inactivity.
Im Ergebnis vertritt der Generalanwalt daher die Auffassung, dass es sich bei dem Bereitschaftsdienst, den ein Arzt in einem Krankenhaus leistet, in vollem Umfang um Arbeitszeit im Sinne der Gemeinschaftsrichtlinie über bestimmte Aspekte der Arbeitszeitgestaltung handelt, und zwar auch insoweit, als es ihm gestattet ist, in Zeiten der Nichtinanspruchnahme zu schlafen.
